1. Agreement to Terms

By accessing or using OrngeChat ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to the hosted OrngeChat service at app.orngechat.site. Self-hosted instances may have their own terms established by their operators.

2. Description of Service

OrngeChat is a communication platform that provides:

  • Encrypted messaging (E2EE for direct messages, encrypted at rest for guild messages)
  • Voice and video communication
  • File sharing capabilities
  • Server/community management features
  • Self-hosting options

The Service is provided "as is" and "as available" without warranties of any kind.

3. User Accounts

3.1 Account Creation

To use certain features of OrngeChat, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

3.2 Age Requirements

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use OrngeChat. By using the Service, you represent that you meet these age requirements.

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion. You may delete your account at any time through your account settings.

4. User Conduct and Prohibited Activities

You agree not to use OrngeChat to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Distribute malware, viruses, or harmful code
  • Engage in harassment, abuse, or threats against others
  • Share illegal content including but not limited to child exploitation material
  • Engage in fraud, phishing, or deceptive practices
  • Spam or send unsolicited commercial communications
  • Attempt to access accounts or data belonging to others
  • Interfere with or disrupt the Service or servers
  • Circumvent security measures or access restrictions
  • Collect user information without consent
  • Use automated systems (bots) without authorization

5. User-Generated Content

5.1 Your Content

You retain ownership of content you create and share on OrngeChat. By posting content, you grant OrngeChat a limited license to store and transmit that content as necessary to provide the Service.

5.2 Content Responsibility

Important: You are solely responsible for content you create, share, or link to on OrngeChat. We do not:

  • Pre-approve or endorse user content
  • Monitor all communications (and technically cannot monitor encrypted content)
  • Guarantee the accuracy, legality, or appropriateness of user content
  • Accept liability for user-generated content

5.3 Third-Party Content and Links

Users may share links to external websites or embed third-party content. OrngeChat is not responsible for:

  • The content, accuracy, or practices of linked websites
  • Any damages arising from accessing third-party content
  • The availability or functionality of external links
  • Content hosted on or linked from third-party services

Accessing external links is at your own risk. We encourage reviewing the terms and privacy policies of any external sites.

5.4 Content Moderation

Due to the encrypted nature of OrngeChat, we cannot proactively monitor message content. However:

  • Server owners/administrators can moderate content within their servers
  • Users can report violations through available reporting mechanisms
  • We will investigate reports and take appropriate action where possible
  • We may remove content or accounts that violate these Terms when reported and verified

5.5 Content Removal

We reserve the right to remove content that violates these Terms. Due to end-to-end encryption on direct messages, we may not be able to access or remove specific DM content. In such cases, we may take action at the account or server level.

6. Self-Hosted Instances

OrngeChat provides software that can be self-hosted. If you operate a self-hosted instance:

  • You are solely responsible for your instance and its users
  • You must comply with all applicable laws in your jurisdiction
  • You are responsible for establishing your own terms and policies
  • OrngeChat has no control over or liability for self-hosted instances
  • Users of self-hosted instances should review the operator's policies

OrngeChat disclaims all responsibility for content, data handling, or conduct on self-hosted instances.

7. Intellectual Property

7.1 Our Property

The OrngeChat name, logo, software, and Service design are the property of OrngeChat. You may not use our trademarks without permission.

7.2 Open Source Components

OrngeChat may include open source software components, which are subject to their respective licenses.

8. Privacy

Your use of OrngeChat is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

9.1 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

9.2 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.3 User Content Disclaimer

WE DO NOT ENDORSE, SUPPORT, REPRESENT, OR GUARANTEE THE COMPLETENESS, TRUTHFULNESS, ACCURACY, OR RELIABILITY OF ANY USER CONTENT OR COMMUNICATIONS POSTED VIA THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORANGECHAT SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, goodwill, or other intangible losses
  • Any damages arising from user-generated content
  • Any damages arising from third-party links or content
  • Any damages arising from self-hosted instances
  • Any unauthorized access to or use of our servers or your data
  • Any interruption or cessation of Service

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless OrngeChat and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you post or share through the Service
